Usage Agreement / Content License & Copyright Notice

This usage agreement / content license and privacy policy (the License) is provided to visitors of the Microsoft Boycott Campaign Web Site (the Site) and subscribers to The Boycott Bulletin Newsletter (the Newsletter) to inform them of the rights and restrictions associated with viewing the content of the Site and/or of the Newsletter. Both the Site and the Newsletter are provided by volunteers working in conjunction with The Microsoft Boycott Campaign (The MSBC). By law, you are not required to accept this License since you have not signed it. However, nothing else grants you permission to view, retain, copy, reproduce, redistribute or modify the contents of the Site or the Newsletter, and doing such is prohibited by the law if you do not accept the License. Therefore, by viewing, retaining, copying, reproducing, distributing, or modifying the content of this Site or the Newsletter, you indicate your acceptance of this License to do so, and all its terms and conditions for handling the copyrighted material.

1A) PRIVACY POLICY / SPAM PROTECTION: The MSBC does not collect personally identifiable information about individuals except when such individuals specifically provide such information on a voluntary basis, submitting information via forms, electronic mail or other methods. Personally identifiable information on individual users provided by those users will not be sold or otherwise transferred to any third parties under any circumstances. We do not support spam - your e-mail will not be released to anyone outside The MSBC for any reason.

1B) STATISTICAL ANALYSIS: The MSBC reserves the right to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the Site or the Newsletter and to inform advertisers of such information as well as the number of users that have been exposed to or clicked on their advertising banners. The MSBC will provide only aggregated data from these analyses to third parties. Users also should be aware that non-personal information and data may be automatically collected through the standard operation of the Site Internet server or through the use of "cookies" sent through third parties (such as advertisers).

1C) PRIVACY PROTECTIONS FOR CHILDREN: The MSBC is by law prohibited from accepting personally identifiable information, including e-mail addresses, from children age 13 or under without permission from a parent or legal guardian. By submitting information to The MSBC, you are confirming that you are either A) over the age of 13 or B) under the age of 13 and have permission to submit personally identifiable information to The MSBC. (If your child has submitted information to The MSBC without permission, please notify us and we will remove the information in question from our records.)

1D) ELECTRONIC MAIL OR OTHER READER SUBMISSIONS: By communicating with The MSBC or participating in any forum on the Site you grant The MSBC an irrevocable, transferable and worldwide right to use, reproduce, publicly display and perform, distribute, sublicense, and sell any suggestions, ideas, drawings or concepts communicated to The MSBC for any purpose it chooses - commercial, public or otherwise - without any compensation to you whatsoever.

2A) DISCLAIMER/LIMITATION OF LIABILITY: The contents of the Site and the Newsletter are provided "as is" without warranties of any kind either expressed or implied. To the fullest extent permissible by applicable law, The MSBC disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The MSBC does not claim that the information contained in the Site or distributed in the Newsletter is accurate, complete, correctly sequenced, reliable, or timely or that the Site or the Newsletter will be uninterrupted or free of errors, and in no instances will The MSBC be liable for any direct, indirect, punitive, special or consequential damages (including loss of profits) that occur because of or in connection with any errors, omissions, inaccuracies, untimelinesses, defects, or unauthenticity of any content in the Site or the Newsletter, or the use or inability to use / view the Site or Newsletter and any content therein. In other words, YOU USE THE INFORMATION WE PROVIDE AT YOUR OWN RISK. In no event shall The MSBC pay for any loss, damage or claim related to or arising from the Site exceeding the total amount you originally paid The MSBC to access the Site or recieve the Newsletter.

2B) LEGAL AUTHORIZATION: The MSBC makes no claims that the materials contained in the Site or the Newsletter are appropriate or authorized for use in all countries, provinces, states, counties or any other jurisdictions. If you choose to access the Site or subscribe to the Newsletter you do so on your own initiative and risk, and are responsible for compliance with all applicable local and national laws.

3A) OWNERSHIP & RESTRICTIONS: All materials contained in the Site and the Newsletter are, except where otherwise indicated, the copyrighted property of The Microsoft Boycott Campaign. Microsoft, Windows, Office, NT, CE, Bob, BackOffice, Bill Gates, 'Where do you want to go today?', the Windows logo, the Internet Explorer logo, the Office logo and any other marks or slogans related to Microsoft products and services are registered trademarks of Microsoft corporation - and it may happily have them. All other trademarks belong to their registered owners.

3B) LICENSE TO REPRODUCE OR REDISTRIBUTE: The Site and the Newsletter are presented to the public under the Open Content License (OCL). The OCL allows you to reproduce or redistribute the contents of the Site or the Newsletter - with the exception of any content owned by other parties - provided that you conspicuously and appropriately publish on each copy an appropriate copyright notice and disclaimer of warranty; keep intact all the notices that refer to this License and to the absence of any warranty; and give any other recipients of the content a copy of or a link to this License along with the content. You may at your option charge a fee for the media and/or handling involved in creating a unique copy for use offline, or you may at your option offer warranty in exchange for a fee. You may not charge a fee for the content itself, or for providing the content by means of the Internet.

3C) CONTENT MODIFICATION: You may modify your copy or copies of the content or any portion of it and distribute such modifications or work under the terms above, provided that you also provide prominent notices stating that you changed the content, along with the exact nature and content of the change(s), and the date of any change(s).

3D) NOTICE TO MICROSOFT AND OTHERS WHO WOULD LAY CLAIM TO OUR MATERIALS: If you are an entity whose servers, services, or protocols attempt to exert a claim to the intellectual property rights of materials passing through your system, be advised that The MSBC is not a party to your agreements. If you try to lay claim to our intellectual property after a posting by a third party, or by an innocent e-mail transmission which is routed through your services, we will treat you as we would any other copyright infringer - to the fullest extent of the law. (This clause is in response to the Microsoft Passport Terms of Use agreement that laid claim to all content sent through the service.)

4A) LICENSE TERMINATION: This agreement is effective until terminated by The MSBC for any reason, with or without notice. Upon any termination of this agreement, you will immediately discontinue your use and access of the Site and/or the Newsletter and destroy all materials obtained from them. The termination of this License terminates all rights to view, retain, copy, reproduce, redistribute, or modify the content - but does not terminate the privacy rights extended to you in clauses 1A-1D.

4B) LICENSE UPDATES: The MSBC may amend or modify this License or impose new conditions at any time upon inclusion of a notice on the Site and in the Newsletter signifying that this License has been updated. Any use of the Site or the Newsletter by you after such update shall be deemed to constitute acceptance by you of such amendments, modifications or new conditions.

 THESE TERMS ARE EFFECTIVE AS-OF 12:00 AM EDT, MAY 7, 2001.
